1. Acceptance of Terms

By accessing or using EDGE SEND ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EDGE SEND is a messaging API and dashboard platform that routes messages across channels (SMS, WhatsApp, email, and email-to-SMS) to the lowest-cost deliverable path, and provides related features including OTP verification, threads, templates, number management, webhooks, analytics, and billing.

3. Eligibility & Accounts

You must be at least 18 years old or of legal age in your jurisdiction.
You are responsible for maintaining the confidentiality of your account credentials and API keys.
You agree to provide accurate registration information and keep it current.

4. Acceptable Use & Compliance

You agree to use the Service in compliance with all applicable laws and regulations, including but not limited to:

The U.S. Telephone Consumer Protection Act (TCPA), Canada's CASL, the UK/EU GDPR, and any local anti-spam laws.
Carrier and platform policies (e.g., WhatsApp Business / Meta policies).
Honoring opt-out and consent requirements. You must only message recipients who have provided appropriate consent.

You may not use the Service to send spam, illegal, fraudulent, or harmful content, or to harass others.

5. Fees, Plans & Billing

Current plans and prices are shown on our pricing page and are subject to change with notice.
Subscription fees are billed in advance via Stripe on a recurring basis until cancelled.
Overage or usage metering may apply beyond plan allowances.
All fees are non-refundable except where required by law.

6. User Content & Data

You retain ownership of your content. You grant us a limited license to process your content solely to provide the Service (e.g., to transmit messages, store records, compute usage). We will not sell your data.

7. Service Level & Availability

The Service is provided "as is" and "as available." While we aim for high availability, we do not guarantee uninterrupted service. Delivery of messages depends on third-party carriers and platforms outside our control.

8. Intellectual Property

EDGE SEND, its logos, and software are our property. You may not copy, modify, or reverse-engineer the Service except as permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, EDGE SEND shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business. Our total aggregate liability shall not exceed the fees you paid in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless EDGE SEND and its owners from claims arising out of your use of the Service, your violation of these Terms, or your violation of third-party rights.

11. Termination

You may cancel your account at any time. We may suspend or terminate access for violation of these Terms, illegal activity, or non-payment, with reasonable notice where practicable.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service. Continued use after changes constitutes acceptance.
